Industrial & Hazardous Waste – BBM attorneys provide assistance with all types of waste management, including developing waste management strategies, securing permit authorizations, and determining compliance at facilities that generate, transport, store, dispose, and otherwise manage industrial waste.
Municipal Solid Waste – BBM attorneys assist clients with permitting, compliance, and enforcement issues concerning waste disposal, transport, transfer, incineration and other municipal solid waste (MSW) management activities. BBM’s attorneys are experienced with MSW permitting requirements, having obtained permits for new MSW facilities, for the expansion of existing MSW facilities, and for the development of closed landfills. BBM also provides assistance in critically reviewing proposed MSW permit applications.
Superfund – BBM offers representation and counsel to Potentially Responsible Parties (PRPs) and others involved in federal Comprehensive Environmental Response, Compensation and Liability Act (CERCLA or Superfund) and state superfund actions.
Waste Classification – BBM attorneys provide assistance in the evaluation and regulatory interpretation of industrial materials and characterization as Class 1, Class 2, Class 3 and/or hazardous wastes.
Compliance – BBM attorneys provide assistance and counsel to clients seeking to determine compliance through self-evaluative audits and to clients responding to agency enforcement actions.
Contaminated Site Cleanup – BBM attorneys provide assistance in navigating the regulatory remediation requirements in response to accidental spills and discharges of regulated substances or the discovery of historical contamination. Assistance is also provided with the clean-up of contaminated properties under various TCEQ programs, including the Voluntary Cleanup Program (VCP), the Innocent Owner Program (IOP), and other Brownfields programs intended to assist in preserving or restoring property value. BBM provides assistance related to the TCEQ Texas Risk Reduction Program (TRRP), Petroleum Storage Tanks (PSTs), and other remediation rules. BBM has experience working with persons responsible for environmental contamination as well as those impacted by contamination from off-site sources.
